Terms of Service

1. Introduction and Acceptance

Welcome to TripsCircle LLC ("TripsCircle," "we," "us," or "our"). TripsCircle is a travel planning and social platform that helps individuals and groups plan trips, share itineraries, split expenses, connect with friends, explore destinations, and use optional AI-assisted planning tools.

These Terms of Service ("Terms") govern your access to and use of the TripsCircle mobile applications, websites (including tripscircle.com), APIs, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Eligibility and Account Registration

TripsCircle accounts and online features require you to be at least 13 years old. We do not offer child accounts or parental-consent accounts for children under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian where required by law.

At account creation, we perform a one-time, privacy-preserving age-eligibility check. Where Apple’s silent regulatory preflight reports that age-range sharing is required, TripsCircle uses Apple’s Declared Age Range service. Everywhere else, including unsupported or unavailable preflight paths, your acceptance of these Terms records your self-declaration that you meet the 13+ account requirement. A completed account result does not expire or repeat when you sign in. We store only the coarse eligibility result, source, and operational timestamp—not your birthday, birth year, exact age, or Apple age-range bounds.

If an account is identified as under 13, we may immediately restrict access, stop data collection and active features, revoke sessions, and route the account through a recoverable administrator-reviewed deletion process. You may not misrepresent age eligibility or evade these controls.

You must provide accurate, current, and complete registration information and keep your account information up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You may register using email and password or, where available, third-party sign-in methods such as Sign in with Apple. Third-party authentication is subject to the provider's terms and policies in addition to these Terms.

You may not create an account using a false identity, impersonate another person, create multiple accounts to evade restrictions, or register on behalf of someone else without permission.

3. Description of the Service

TripsCircle provides tools for trip creation, itinerary management, expense tracking and settlement suggestions, group collaboration, messaging, social connections, achievements and travel stats, maps and location features, notifications, and optional AI-generated planning suggestions.

Features may vary by platform (mobile, web), account status, region, and product version. We may add, modify, suspend, or discontinue features at any time.

The Service may include content, recommendations, maps, alerts, and AI outputs that are provided for planning convenience only. TripsCircle does not book travel, provide insurance, act as a travel agency, or guarantee the accuracy, safety, legality, availability, or suitability of any destination, route, venue, price, or recommendation.

• Trip and profile privacy controls (public, friends/connections, or private).
• Feed visibility controls, including options to hide trips from the feed.
• Group trip invitations, crew management, and shared planning surfaces.
• Direct and group messaging between connected users and trip participants.
• Expense records, receipt attachments, and settlement calculations among trip members.
• Optional payment-handle fields (such as Venmo or Cash App tags) for convenience between users; TripsCircle does not process payments.
• Push and email notifications, configurable in Settings.
• AI-assisted itinerary drafts based on user-provided inputs.
• Travel maps, saved places, bucket lists, and shareable recap content.

4. User Content and License

"User Content" means any information, text, photos, videos, messages, comments, trip data, expenses, locations, profile details, and other material you submit, post, transmit, or make available through the Service.

You retain ownership of your User Content. By submitting User Content, you grant TripsCircle a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, perform, distribute, modify solely for technical formatting, and otherwise use your User Content only as needed to operate, provide, improve, and secure the Service, including making content available to other users according to your settings and the sharing features you intentionally use.

TripsCircle will not use private User Content in advertising or public marketing without your separate permission.

You represent and warrant that you own or have the necessary rights to your User Content and that your User Content and use of the Service do not violate law or third-party rights.

You are solely responsible for your User Content and the consequences of sharing it. Other users may see, copy, or redistribute content you make public or share with them.

5. Privacy, Visibility, and Sharing

TripsCircle offers privacy controls for profiles, trips, and feed visibility. You are responsible for reviewing and configuring these settings before sharing sensitive information.

Even with private settings, information you share directly with other users, trip members, or support staff may be visible to those recipients. Backups, logs, and legal processes may retain certain data as described in our Privacy Policy.

If you share links to trips, profiles, or invites outside the Service, anyone with the link may be able to access the linked content subject to our access rules.

6. Acceptable Use and Prohibited Conduct

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Violating any applicable law, regulation, or third-party right.
• Harassing, threatening, defaming, stalking, or discriminating against others.
• Posting unlawful, fraudulent, obscene, hateful, exploitative, or sexually explicit content.
• Sharing content that endangers minors or facilitates illegal activity.
• Impersonating any person or entity or misrepresenting affiliation.
• Collecting or harvesting data from the Service without authorization.
• Scraping, reverse engineering, or attempting to access non-public areas of the Service.
• Interfering with or disrupting the Service, servers, or networks.
• Uploading malware, spam, or automated scripts that burden the Service.
• Circumventing security, access controls, rate limits, or privacy settings.
• Using the Service for unsolicited marketing, phishing, or pyramid schemes.
• Posting false reviews, fake trips, or manipulated engagement.
• Using AI outputs to mislead others about real bookings, safety conditions, or legal requirements.
• Reporting false abuse claims or abusing moderation tools.

7. Moderation, Enforcement, and Reporting

We may review, remove, restrict, or disable User Content or accounts that violate these Terms, create risk, or harm the community, with or without notice where permitted by law.

You may report users or content through in-app moderation controls or by contacting support. We are not obligated to monitor all content but may do so.

Repeated or severe violations may result in suspension or permanent termination. We may preserve records relating to investigations and enforcement.

8. Third-Party Services and Links

The Service integrates with and links to third-party services, including Sign in with Apple, the Apple App Store, Google Play, cloud infrastructure, Apple Maps, Google Places, Mapbox, email and push-notification infrastructure, image providers, and AI model providers accessed through our backend.

Third-party services are governed by their own terms and privacy policies. TripsCircle is not responsible for third-party services, external websites, booking platforms, or payment apps you choose to use.

If you follow an external link, enable a third-party integration, or share payment handles with other users, you do so at your own risk.

9. AI-Assisted Features

Certain features use automated systems, including large language models accessed through service providers, to generate itinerary suggestions, summaries, and planning drafts based on your inputs.

AI outputs may be incomplete, outdated, inaccurate, or inappropriate for your circumstances. You must independently verify hours, prices, safety, accessibility, visa requirements, health guidance, and local laws before relying on any suggestion.

Do not submit sensitive personal data you do not want processed for AI features. We may store AI request inputs and outputs as described in our Privacy Policy.

Do not submit another person's personal information to an AI feature unless you have permission to do so.

AI features are provided "as is" without guarantees of fitness for a particular trip or outcome.

10. Expenses, Settlements, Payment Handles, and Premium Subscriptions

TripsCircle may help trip members record shared expenses and calculate settlement suggestions among participants. These calculations are informational tools only.

TripsCircle does not move money, escrow funds, issue refunds, or guarantee that users will pay one another. Any payment between users occurs outside the Service through third-party apps or methods you select.

Optional profile or trip fields for payment handles (such as Venmo or Cash App) are displayed at your direction. You are responsible for sharing accurate handles and for transactions you initiate off-platform.

TripsCircle Premium is an optional auto-renewing monthly subscription offered through the Apple App Store on iOS and Google Play on Android. Payment is charged to the store account you use when you confirm purchase. For Apple subscriptions, renewal and billing continue under the existing App Store terms, including Apple's notice that cancellation should occur at least 24 hours before the current billing period ends.

The price, billing period, and any introductory offer available to you are displayed by the applicable store before you confirm. Taxes and currency conversion may apply through that store. If an introductory offer applies, the subscription automatically continues at the displayed standard price unless canceled before the offer ends.

You may manage or cancel a subscription in your Apple ID subscription settings or Google Play subscription settings, according to where you purchased it. Deleting your TripsCircle account, removing the app, or stopping use of the Service does not cancel a store subscription. Unless the applicable store provides otherwise, Premium access continues through the end of the paid period after cancellation, and refunds are handled according to that store's policies.

11. TripsCircle Intellectual Property

The Service, including its software, design, branding, logos, text, graphics, and compilations (excluding User Content), is owned by TripsCircle or its licensors and protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as expressly permitted by law or with our written consent.

12. Feedback

If you submit ideas, suggestions, or feedback, you grant TripsCircle a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without restriction or compensation.

13. Mobile Applications and App Stores

If you download the Service from an app store, you acknowledge that these Terms are between you and TripsCircle, not the app store provider.

The app store provider has no obligation to furnish maintenance or support for the Service. In the event of any failure of the Service to conform to an applicable warranty, you may notify the app store provider for a refund of the purchase price, if any; to the maximum extent permitted by law, the app store provider has no other warranty obligations.

TripsCircle, not the app store provider, is responsible for addressing claims relating to the Service or your possession or use of it, including product-liability claims, claims that the Service fails to conform to applicable legal or regulatory requirements, and consumer-protection claims.

If a third party claims that the Service or your possession and use of it infringes intellectual property rights, TripsCircle, not the app store provider, is responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms or applicable law.

You represent that you are not located in a country subject to U.S. government embargo and are not listed on any U.S. government prohibited or restricted party list.

You must comply with applicable third-party terms when using the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms for an iOS app downloaded from the App Store and may enforce these Terms against you as such a beneficiary.

14. Communications and Notifications

By creating an account, you agree that TripsCircle may send you service-related communications, including security alerts, trip activity, invitations, and account notices, by email, push notification, or in-app message.

You can manage many non-essential notifications in Settings. Some transactional or legal notices may still be sent.

Marketing or product-update messages are sent according to your preferences where required by law.

15. Suspension, Termination, and Account Deletion

You may stop using the Service at any time. You may request account deletion through in-app settings or by contacting support.

We may suspend or terminate your access immediately if you violate these Terms, create risk, or where required by law.

Upon termination, your right to use the Service ends. Certain provisions survive termination, including intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms.

Deletion requests are processed as described in our Privacy Policy. Some data may be retained in backups or where retention is legally required.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPSCIRCLE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TRIPSCIRCLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT USER CONTENT OR AI OUTPUTS WILL BE ACCURATE OR RELIABLE.

ANY TRAVEL DECISIONS YOU MAKE ARE YOUR RESPONSIBILITY. TRIPSCIRCLE IS NOT RESPONSIBLE FOR INJURY, LOSS, DELAY, CANCELLATION, THEFT, DISPUTES AMONG TRAVELERS, OR FINANCIAL LOSS ARISING FROM TRIPS PLANNED OR COORDINATED THROUGH THE SERVICE.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPSCIRCLE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPSCIRCLE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TRIPSCIRCLE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless TripsCircle and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

19. Dispute Resolution, Governing Law, and Venue

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.

Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.

Except where prohibited by law, you and TripsCircle agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Kansas, and you consent to personal jurisdiction in those courts.

If you are a consumer in the European Union or United Kingdom, you may also have the right to bring claims in your country of residence under mandatory law.

20. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will provide notice through the Service, by email, or by updating the effective date above.

Changes apply prospectively from the stated effective date. Where required by law, we will request your affirmative acceptance. If you do not agree to revised Terms, you must stop using the Service and may delete your account.

21. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and TripsCircle regarding the Service.

If any provision is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce a provision is not a waiver of our right to do so later.

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
